| Application of ss._5—8 | 70.70.(1) | Sections 5 to 8 apply unless, |

| (a) | an
application under section 4 of the Family Law Reform
Act, being chapter 152 of the Revised Statutes of
Ontario, 1980 was adjudicated or settled before the 4th
day of June, 1985; or |
||||||||||||||||||||||||||||||
| (b) | the
first spouse's death occurred before the 1st day of
March, 1986. |

| Application of Part II | 70.(2) | Part II (Matrimonial Home) applies unless a proceeding under
Part III of the Family Law Reform Act, being
chapter 152 of the Revised Statutes of Ontario, 1980 to
determine the rights between spouses in respect of the
property concerned was adjudicated or settled before the
4th day of June, 1985. |

| Interpretation of existing contracts | 70.(3) | A
separation agreement or marriage contract that was
validly made before the 1st day of March, 1986 and that
excludes a spouse's property from the application of
sections 4 and 8 of the Family Law Reform Act,
being chapter 152 of the Revised Statutes of Ontario,
1980, |

| (a) | shall
be deemed to exclude that property from the application
of Section
5 of this
Act; and |
||||||||||||||||||||||||||||||
